Regulatory Framework


This section provides regulatory information relating to the process and drafting of the new 2012-2020 Planning Schedule.

Under the provisions of article 4 of the Hydrocarbons Industry Law 34/1998, of 7 October, amended by Law 12/2007, the Government is responsible for planning on hydrocarbons, with the participation of the Autonomous Communities. 

That article also establishes that the planning shall be binding for the purposes of assurance of supply of hydrocarbons with regard to: the facilities making up the natural gas transmission network; the secondary transmission network; determination of the total liquid natural gas regasification capacity necessary to supply the gas system; storage facilities for strategic reserves of liquid hydrocarbons and for the basic storage of natural gas; and determination of general criteria for developing retail supply facilities for petroleum products.

Article 64 of the Act entrusts the Technical Manager of the Gas System with making proposals for the development of the basic network and the extension and/or increase of storage facilities, and stipulates that the Technical Manager shall work in coordination with the various parties that operate or use the gas system. Therefore, both in the case of a new plan and for the revision of an existing plan, once the Government has initiated the planning process, the Technical Manager of the System is responsible for drawing it up.

On 28 December 2010, the Technical Manager of the System sent the first draft of its proposal for the 2012-2020 Planning Schedule to the Department of Energy Planning and Monitoring, in accordance with the stipulations of article 11 of Royal Decree 1955/2000.


  • Royal Decree 1955/2000

    Royal Decree 1955/2000, governing electricity sector activities, states in article 11.4 that, during the planning process, once the system operator has received proposals from the different participating agents, it shall conduct the necessary planning studies, using the results to draw up an initial development proposal, which must be submitted to the Ministry of Industry, Tourism and Trade within six months.

  • ITC/2906/2010

    Ministerial Order ITC/2906/2010, approving the annual programme for transmission network facilities, specifies that, for consistency and to ensure proper coordination, the deadlines set in Royal Decree 1955/2000 must be extended to the gas sector. Consequently, the Department of Energy Planning and Monitoring deemed the six-month time limit to be applicable for the submission to the Ministry of Industry, Tourism and Trade of the initial proposal for development of the natural gas transmission network.
